COVID-19

Pursuant to Governor Beshear's Executive Order 2020-586, dated July 9, 2020, which can be found here in its entirety, Holbrook & Holbrook must require that all parties attending a closing in any of its offices "cover their nose and mouth with a face covering," so long as they are not exempted by the Order.  We understand the inconvenience and discomfort associated with masks for some individuals and are happy to make any accommodations possible.  Thank you for your continued understanding and support through these trying times.

The Fayette County Clerk's Office is now back to recording documents in the land records after a one week hiatus.

Pursuant to SB 150, Kentucky notaries are now permitted to perform closings via video conferencing technology, e.g. Zoom, if the signing parties are located inside the Commonwealth of Kentucky.  Please let us know if you would like to execute your closing documents in this manner so that we can arrange to have the documents picked up or delivered in advance of your closing.

We would like to reiterate that in order to fully comply with social distancing guidelines, ONLY SIGNING PARTIES ARE PERMITTED TO ATTEND IN-PERSON CLOSINGS.  We are happy to coordinate for any document signatures or checks that would typically be obtained or exchanged at closing.  The best thing you can do for your client is to not risk their health by attending the closing.

The Fayette County Clerk's office has announced that it will be "closed for all business" effective immediately.  We expect other county clerk's offices across the Commonwealth may follow suit in short order.  Although that does mean that recordings will be delayed, closings can still continue under guidelines set by our title insurance underwriter.  Although nearly always a valuable and wise investment, an optional owner's title insurance policy is strongly recommended during these unprecedented times.  The policy would be a buyer's only recourse for an issue arising during the period of time county clerks are not recording documents.

Governor Beshear’s Executive Order of March 25, 2020 (found here in its entirety) specifically states that “banks, credit unions, . . . mortgage loan companies, mortgage loan brokers, originators and processors . . . . legal services, accounting services, insurance services, real estate services (including appraisal and title services)” are “life-sustaining” businesses and thus exempt from the order to cease operations.  As such, Holbrook & Holbrook will continue to support its friends and clients by performing closings pursuant to the social distancing guidelines.

In a further effort to emphasize social distancing while continuing to support our friends and clients throughout this trying time, Holbrook & Holbrook is now requiring all parties to execute closing documents at separate times.  While we appreciate and value the celebratory atmosphere that having everyone together creates, it is simply not compatible with social distancing guidelines.  We have also spread out the work spaces of the in-office staff who are not able to perform their duties from home.  Please do not hesitate to contact Jodie Tharp directly at

As of March 20, 2020 all county clerk's offices are accepting recordings, and no delay in recording is expected.  Holbrook & Holbrook is conducting closings based on CDC guidance as outlined below.  Check back frequently for any developments.

At Holbrook & Holbrook Law Office, our first priority is the well-being of our staff, friends, and clients.  In response to the increasing cases of the coronavirus, Holbrook & Holbrook is instituting the following procedures effective immediately:

  1. Post-Closing Disinfecting – After each closing, the chairs, table, door handles and other surfaces will be wiped down with disinfecting wipes or other bleach solution.
  2. Closing Table Items – All pens, paper, extra reading glasses and other items normally found on our closing tables have been removed. New pens will be distributed to each closing participant and are to be retained by each participant after closing.
  3. Separated Parties at Closings – When possible, we are requesting buyers and sellers execute documents separately, at staggered times during the closing. E.g. Buyers at 1:00, Sellers at 1:30. This procedure minimizes the contacts between parties and is consistent with current CDC guidance on social distancing.

Non-signing parties – We are requesting that ALL “non-signing” parties (typically real estate agents, loan officers, family members) not attend the closings.  Attendance by conference call or skype/FaceTime is encouraged.  We are happy to facilitate execution of any documents real estate agents need.  Many documents, (pest inspection, final walk through, etc may be signed through dot loop as original signatures are not required on these documents).

If any person has cold or flu-like symptoms, please let us know in advance of closing to determine a possible solution.  We look forward to a return of the warm greetings, hugs, and handshakes at our closings in the near future.

In light of the recent directives from the CDC and other government entities on social distancing, in-person access is being limited by nearly all County Clerks and PVA.  We expect more closings and limitations in the coming days.  As such, title examinations must be performed online for the near future.  We have access through various online portals, both public and to which we subscribe, to continue examining the land records. 

Currently, most County Clerk’s offices are continuing to accept recordings, and our closings will continue as scheduled.   If a County Clerk’s office ceases operations completely and will no longer accept recordings, a scheduled closing can still continue under guidelines set by our title insurance underwriter.    Please know title insurance underwriter guidance is subject to change based on the actions of County Clerks or other government agencies.
